How Long After an Accident Can You File an Insurance Claim?

After an accident in Texas, you must file a personal injury claim within two years from the date of the accident.

This statute of limitations also applies to those hoping to file a claim for property damage resulting from an accident.

A failure to file within this specified period bars you from filing at a later time. Two years may seem like plenty of time to file a claim.

However, it is easy to let this time pass when faced with severe injuries and a lengthy recovery.

It’s crucial to contact a personal injury attorney as soon as possible so that they may begin exploring options for your compensatory relief.

Does An Insurance Company Have to Respond to My Claim?

Under Texas law, an insurance company must respond to a filed claim.

Within 15 days of notice of the claim, the insurance company must do the following:

  • Acknowledge receipt of the claim,
  • Begin investigating the claim, and
  • Request relevant information, statements, and forms from the claimant.

Additionally, after properly investigating your claim, an insurance company must notify you whether your claim was accepted or rejected.

Most situations require an insurer to notify a claimant of the acceptance or rejection of their claim within 15 days after the insurer receives all information, statements, and forms needed to investigate the claim correctly.

In some situations, insurance companies may request an extension of 45 days. These extensions are only granted if the insurer provides a sufficient basis for doing so.

How Long Does an Insurance Claim Take?

After an accident, you may wonder, How long do insurance claims take?

You may be eager to rush through the claim review process to receive payment. However, it is usually impossible to shorten the statutory timeframe insurance companies must follow.

Compiling as much relevant information as possible immediately after your accident may encourage the expeditious review and process of your claim.

For example, obtaining witness statements, accident reports, and proof of loss forms helps speed up the process.

Also, insurance companies use certain tactics to try and delay your claim.

A qualified personal injury attorney can help hold their feet to the fire and can negotiate on your behalf throughout this process.
